The <strong><a href=\"https:\/\/www.ocean.edu\/wp-content\/uploads\/2025\/10\/5247-Code-of-Student-Conduct-Manual-10.9.25_.pdf\">Code of Student Conduct in Policy #5247 (PDF)<\/a><\/strong> is designed to address all student misconduct, excluding sex-based misconduct. Sex-based misconduct for both students and employees is covered under Federal Title IX regulations and addressed by&nbsp;<a href=\"https:\/\/www.ocean.edu\/wp-content\/uploads\/2025\/02\/2410-Policy-and-Procedure-6.27.24-w-links.pdf\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>Policy #2410 (PDF)<\/strong><\/a>, Nondiscrimination, Equal Opportunity, and Harassment. <\/p>\n\n\n\n<p class=\"is-style-intro\">Complaints of misconduct alleged against an employee of Ocean County College will be addressed under the&nbsp;<a href=\"https:\/\/www.ocean.edu\/wp-content\/uploads\/2025\/02\/5230-Policy-and-Procedure-1.23.25.pdf\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>Formal Student Complaint Policy #5230<\/strong><\/a>. We provide an environment in which all college community members are treated with respect and dignity through utilizing a variety of methods for both individuals and groups.<\/p>\n\n\n\n<p><strong>Goals<\/strong><\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>To develop, interpret, and enforce campus policies<\/li>\n\n\n\n<li>To ensure compliance with Federal Title VI, Title VII, and Title IX laws and reporting requirements<\/li>\n\n\n\n<li>To facilitate and encourage a community of respect<\/li>\n\n\n\n<li>To administer a disciplinary process that maintains the integrity of the academic community and to uphold due process rights of students<\/li>\n\n\n\n<li>To provide learning experiences for all students and especially those who participate in the conduct process<\/li>\n<\/ol>\n\n\n\n<p style=\"padding-top:var(--wp--preset--spacing--30)\"><strong>Due Process, Standard of Evidence, and Sanctioning<\/strong><\/p>\n\n\n\n<p>The student conduct process is quite different from criminal and civil court proceedings. Student conduct procedures and rights are managed with fairness to all, but do not include the same protections of due process afforded by the courts. Due process, as defined within this code, assures written notice, a thorough and equitable investigation, and the right to appeal in writing a finding or sanction, or both, based on specific grounds, as outlined in this document. Preponderance of the evidence is the evidence standard for this code. No student will be found in violation of Ocean County College policy or the Code of Student Conduct without information showing that it is more likely than not that a violation occurred, and sanctions will be proportionate to the severity of the violation and to the cumulative conduct history of the student.<\/p>\n<\/div>\n<\/div>\n\n\n\n<div class=\"wp-block-columns alignwide is-layout-flex wp-container-core-columns-is-layout-3 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\">\n<div class=\"wp-block-group pattern-accordion accordion__items is-layout-flow wp-block-group-is-layout-flow\">\n<div class=\"wp-block-group pattern-title-block is-layout-flow wp-block-group-is-layout-flow\">\n<h2 class=\"wp-block-heading\">Investigation Process<\/h2>\n\n\n\n<div class=\"wp-block-group pattern-title-block__text is-layout-flow wp-block-group-is-layout-flow\">\n<p>When a concern regarding a potential violation of the Student Code of Conduct is reported to us through our web-based forms, campus security reports, or a police report, the process for investigating the concern follows the processes and procedures outlined in <strong>Ocean County College Policy #5247<\/strong><\/p>\n<\/div>\n\n\n\n<div class=\"wp-block-buttons is-layout-flex wp-block-buttons-is-layout-flex\"><\/div>\n<\/div>\n\n\n\n<div class=\"wp-block-buttons accordion__all is-layout-flex wp-block-buttons-is-layout-flex\">\n<div class=\"wp-block-button is-style-outline accordion__expand-all is-style-outline--1\"><a class=\"wp-block-button__link wp-element-button\">Expand All<\/a><\/div>\n\n\n\n<div class=\"wp-block-button is-style-outline accordion__collapse-all is-style-outline--2\"><a class=\"wp-block-button__link wp-element-button\">Collapse All<\/a><\/div>\n<\/div>\n\n\n\n<div class=\"wp-block-group accordion__item is-layout-flow wp-block-group-is-layout-flow\">\n<div class=\"wp-block-group accordion__preview is-layout-flow wp-block-group-is-layout-flow\">\n<div class=\"wp-block-buttons is-layout-flex wp-block-buttons-is-layout-flex\">\n<div class=\"wp-block-button accordion__toggle\"><a class=\"wp-block-button__link has-text-align-left wp-element-button\">Overview of the Process<\/a><\/div>\n<\/div>\n<\/div>\n\n\n\n<div class=\"wp-block-group accordion__content is-layout-flow wp-block-group-is-layout-flow\">\n<p>Incident reports, campus security reports, and police reports are reviewed by the Office of Student Conduct.&nbsp; Involved individuals will be invited to discuss the incident with a Student Conduct Investigator.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Student engages in or observes behavior that may be against policies<\/li>\n\n\n\n<li>A concern is reported to the Conduct Office from a reporting party. <a href=\"https:\/\/www.ocean.edu\/campus-life\/campus-safety\/report-a-concern\/\">Report a concern here.<\/a><\/li>\n\n\n\n<li>The Office of Student Conduct receives the report<\/li>\n\n\n\n<li>The case is assigned to a Student Conduct Investigator for investigation<\/li>\n\n\n\n<li>Notice of Investigation and Alleged Violation sent to all parties (reporting party and responding party). NOTE: Interim measures may be enacted while the investigation proceeds to support involved parties.<\/li>\n\n\n\n<li>Conduct Administrator meetings will begin with students to go over incident report. In this case, the sanctions are applied and the process ends.<\/p>\n\n\n\n<p><strong>Student Rejects Findings<\/strong><\/p>\n\n\n\n<p>Student rejects the finding(s) and\/or the sanction(s) by filing an appeal within seven business days to the Vice President of Student Affairs (VPSA).<\/p>\n\n\n\n<p>Appeal approved (procedural error) \u2013 A new investigation begins with a new Conduct Administrator as the lead. If the outcome of this investigation finds the responding party responsible, a trained Administrator from the ARP with no connection to the case will determine and issue the appropriate sanction(s).<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The VPSA will review all appeal requests and determine if there is a reasonable cause as defined by the code that the grounds for an appeal have been met.\n<ul class=\"wp-block-list\">\n<li>Denied basis for an appeal \u2013 the responding student will be notified within seven business days. This decision is final and ends the process.<\/li>\n\n\n\n<li>Approved basis for an appeal \u2013 the responding student will be notified and the case\/appeal will be reviewed by an Administrative Review Panel (ARP) within 10 business days of the approval.\n<ul class=\"wp-block-list\">\n<li>ARP confidentially reviews all case documentation and decides if the appeal is approved or denied by a simple majority vote.<\/li>\n\n\n\n<li>Appeal approved \u2013 the panel may remove or revise the sanctions.
